The new civil statute of limitations came into force on January 1st 2020.

The main objective of the revision was to extend the short limitation periods of one year for claims for unjust enrichment and tort, which are briefly compared to European Law. This was implemented as follows:

The relative limitation periods for actions in tort (Art. 60 para. 1 OR) and unjust enrichment (Art. 67 para. 1 OR) are now 3 years.

With the revision, numerous other changes in the statute of limitations have been implemented, of which Kaiser Odermatt & Partner would like to highlight two points. With regard to the following points, we can also provide you with our specialist knowledge to achieve a settlement in debt disputes and to increase the enforcement in bankruptcy:

1. Art. 141 OR: (written waiver of the plea of limitation is possible from the beginning of the limitation period of a maximum of 10 years)
